The agreement between integrators and Skydata.1 LLC for use of the Image Trust Protocol API.
Image Trust Protocol ("the Service") is a verification API that returns multi-source fact-check verdicts on images and claims. Verdicts are aggregated from public records published by credentialed fact-check organizations, with attribution to the originating publisher preserved on every response.
The Service is offered on a business-to-business basis. The intended consumers are integrators: AI agent developers, browser extension publishers, content-provenance vendors, fact-check platforms, and similar applications that surface verification results to their own end users.
Authentication and billing are handled by sapph1re's MCP Billing Gateway, a third-party service that issues API keys, meters usage, and processes payment.
By calling the Service with a valid API key, you agree to these terms on behalf of yourself or the organization you represent. If you do not agree, do not call the Service.
API keys are issued by sapph1re's MCP Billing Gateway. You are responsible for keeping your API key confidential. You should not embed it in client-side code, mobile binaries, browser extensions distributed to end users, or any other surface where the key can be extracted.
You are responsible for all activity associated with your API key. If you believe your key has been compromised, rotate it through sapph1re and notify us at the contact address below.
You may use the Service to surface verification results inside your own product, with proper attribution to the originating publishers as returned in each API response.

The Service is billed per API call by sapph1re's MCP Billing Gateway. Current pricing is published at imagetrustprotocol.world. Specific dollar amounts are not fixed by these terms; refer to the pricing page in effect at the time of your call.
Sapph1re processes payment via Stripe (card payments) or via x402-protocol USDC payments on the Coinbase Base network. Payment terms, invoicing, refunds, and chargebacks are governed by sapph1re's terms in addition to these. The Service applies rate limits at both the gateway and the backend. Specific thresholds are not fixed by these terms and may be adjusted to maintain service stability for all integrators. If your application requires sustained throughput above the standard limits, contact us at the address below to discuss.
Verdicts returned by the Service are aggregated from public fact-check records authored by third-party publishers. We make no representation or warranty that any individual verdict is correct, current, complete, or applicable to any specific use you may make of it. Publishers occasionally update or retract their conclusions; the corpus reflects the state of those records at the time of ingestion and refresh.
Integrators must not present the Service's output to end users as definitive proof of authenticity, manipulation, fabrication, or any specific claim about a person depicted. Output should be presented as aggregated third-party fact-check information with the publisher attribution intact.
Decisions about content moderation, publication, removal, or any other consequential action taken on the basis of a verdict are the integrator's responsibility, not ours.
The Service, including the API, the aggregation logic, the agent setup instructions, and the marketing materials, is the property of Skydata.1 LLC. The fact-check records aggregated in the corpus are the property of their respective publishers. Attribution returned in API responses is intended to preserve those publishers' authorship.
You retain ownership of any data you send to the Service. You grant us a limited license to process that data for the purpose of returning a verification response and for the operational purposes described in our Privacy Policy.
The Service is offered on an "as available" basis. We aim for high availability but do not commit to a specific uptime percentage in these terms. Planned maintenance, third-party outages (Neon, Railway, sapph1re, Anthropic, Google), and unanticipated incidents may cause temporary unavailability.
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation, to the maximum extent permitted by law.
To the maximum extent permitted by law, Skydata.1 LLC, its members, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities, arising out of or related to your use of the Service.
Our aggregate liability arising out of or related to the Service shall not exceed the greater of (a) the amounts you paid for the Service in the twelve months preceding the claim, or (b) one hundred US dollars.
Some jurisdictions do not permit the exclusion or limitation of certain damages. In those jurisdictions, the limitations above apply to the maximum extent permitted.
You agree to indemnify and hold harmless Skydata.1 LLC, its members, employees, and contractors from any claims, damages, liabilities, and costs (including reasonable attorneys' fees) arising from your use of the Service, your violation of these terms, your violation of applicable law, or your violation of the rights of any third party.
You may stop using the Service at any time. Sapph1re's billing terms govern any final invoicing.
We may suspend or terminate your access to the Service for material breach of these terms (including the acceptable use restrictions in section 4), for non-payment as reported by sapph1re, in response to legal process, or to protect the integrity of the Service. Where practical, we will give notice; in cases of suspected abuse or active harm, we may act first and notify after.
Sections 7 (accuracy disclaimer), 8 (intellectual property), 10 (warranty disclaimer), 11 (limitation of liability), 12 (indemnification), and 14 (governing law) survive termination.
These terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-laws principles. The federal and state courts located in Colorado have exclusive jurisdiction over any dispute arising out of or related to these terms or the Service, and you consent to that jurisdiction and venue.
We may update these terms as the Service evolves. The effective date at the top of the page reflects the last revision. Material changes will be communicated to active integrators through the contact channel on file with sapph1re. Continued use of the Service after the effective date of an update constitutes acceptance of the updated terms.
If any provision of these terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later. You may not assign these terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. These terms, together with the Privacy Policy and any pricing terms in effect at the time of your call, constitute the entire agreement between you and Skydata.1 LLC regarding the Service.
